This is intentional due to the public rooms api not supporting spaces properly, should be capabilities gated at minimum

Is this mandated by the spec? This feels a little weird, tbh, I'd imagine the server should handle the filtering if we don't want to show these

No it was a choice at the implementation time, same reason we don't expose the publish toggle switch
