what is pub and what is the opinion on pub and zip TLDs?

Heya,
I'm really enjoying the lists.
I've come across Spam recently registering a .zip domain for phishing purposes. (I.e. Steampowered.com.SteamSetup.1.3.2.zip with "2.zip" being the registered domain.) I know that just blocking TLDs in the malware-list will inevitably cut off legitimate uses, but I have personally not seen a legitimate application for these. I feel TLDs resembling file-extensions should be barred from being publicly available for purchase.
But I can see how this might impact usability and acceptance of the list.
Has this come up before?
